Welcome to ClaimArmor. These Terms of Service (“Terms”) govern your access to and use of the ClaimArmor platform, including our website, console, APIs, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using ClaimArmor, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Eligibility

The Service is available only to:

  • Licensed public adjusters in good standing
  • Licensed attorneys practicing in insurance or related fields
  • Authorized representatives of licensed adjusting or legal firms
  • Other insurance professionals approved by ClaimArmor

You must be at least 18 years old and capable of forming a binding contract. All applicants are subject to verification and approval at ClaimArmor’s sole discretion.

3. Account Registration & Security

You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the security and confidentiality of your login credentials
  • Enable two-factor authentication when required
  • Immediately notify us of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

ClaimArmor reserves the right to suspend or terminate accounts that violate these Terms or pose security risks.

4. Service Description

ClaimArmor provides AI-powered tools and services designed to assist insurance professionals with claims-related tasks. The Service includes:

  • AI-powered claims analysis and document generation
  • Report creation and management tools
  • Secure document storage and retrieval
  • Professional collaboration features

Important: ClaimArmor is a professional tool, not a substitute for professional judgment. All AI-generated content should be reviewed, verified, and approved by qualified professionals before use.

5. Token System & Payment

ClaimArmor operates on a prepaid token system:

  • Tokens must be purchased before using billable features
  • Token consumption is based on actual AI processing usage
  • Token balances are displayed in real-time in your account
  • Unused tokens do not expire while your account remains active
  • Refunds are governed by our Billing & Refund Policy

6. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or to violate any laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or attempt to extract source code
  • Share your account credentials with unauthorized parties
  • Use the Service to generate fraudulent, misleading, or false documents
  • Resell, sublicense, or commercially exploit the Service without authorization
  • Circumvent any security measures or usage limitations

Violations may result in immediate account termination without refund.

7. Intellectual Property

Our Property: The Service, including all software, algorithms, designs, text, graphics, and trademarks, is owned by ClaimArmor, LLC and protected by intellectual property laws. “ClaimArmor” and our logo are registered trademarks.

Your Content: You retain ownership of data and content you submit to the Service. By using the Service, you grant ClaimArmor a limited license to process your content solely to provide the Service.

Output: Documents and reports generated using the Service are owned by you, subject to these Terms and any applicable professional regulations.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

ClaimArmor expressly disclaims all warranties, including:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or completeness of AI-generated content
  • Warranties that the Service will be uninterrupted, error-free, or secure

ClaimArmor does not provide legal, financial, or insurance advice. Users are solely responsible for verifying all information and ensuring compliance with applicable laws and professional standards.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMARMOR SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from reliance on AI-generated content
  • Damages exceeding the amount paid by you in the 12 months preceding the claim

10. Indemnification

You agree to indemnify, defend, and hold harmless ClaimArmor, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

11. Termination

Either party may terminate this agreement at any time. ClaimArmor may suspend or terminate your access immediately if you violate these Terms. Upon termination:

  • Your right to use the Service ceases immediately
  • Unused tokens are forfeited (no refunds)
  • You must cease all use of ClaimArmor intellectual property
  • Provisions that should survive termination will remain in effect

12. Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.

13. Changes to Terms

ClaimArmor may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
